Partnership Firm Registration - An Overview

A partnership firm is a popular business structure where two or more individuals come together to operate a business and share its profits and losses. Registering a partnership firm in India involves a series of steps that ensure the legal recognition and smooth functioning of the business as described below:

  • Choose a Business Name. Select a unique name for your partnership firm.
  • Draft a comprehensive partnership deed. It must be signed by all partners and should ideally be printed on a non-judicial stamp paper, the value of which depends on the state in which the firm is being registered.
  • Registerthe notarizedpartnership deed with the Registrar of Firms. This process involves submitting an application form (Form A), the notarized partnership deed, and other supporting documents such as proof of address of the business place and identity proofs of the partners. The application must be accompanied by the prescribed registration fee. However, it is not mandatory to register a partnership firmunder the Indian Partnership Act, 1932.
  • Apply for a Permanent Account Number (PAN) and Tax Deduction and Collection Account Number (TAN) for the partnership firm.
  • Once the partnership firm is registered, open a bank account in the name of the partnership.
  • Depending on the nature of your business, you may need to obtain specific licenses or permits to operate legally.
